FRASER, Justice.

This is an appeal from the action of the trial court in sustaining the plea of privilege filed by defendant M. L. Minette.

Plaintiff alleged the elements of a trespass to try title suit in the opening paragraphs of his original petition. In the remainder of his petition he alleged that in 1940 one Ernest Riggs executed a lease of certain lands in Pecos County, Texas, to the Humble Oil & Refining Company, which company then gave a farm out of said- lease to one Joe O.
