This case comes before us for the second time, this time on exceptions by the defendant to the allowance of a motion to amend the writ and declaration filed by the plaintiff after the decision of this court in the same entitled action, reported in 146 Me. 206; 79 A. (2nd) 167. In the original writ and declaration, plaintiff failed to allege that he was a duly licensed and qualified real estate broker under the laws of Maine and this court held that under and by virtue of R.
