WILLIAMS, Justice.

This is an appeal from a judgment of the district court of Osage County affirming the order of the County Court of Osage County, determining the heirs and distributing the assets in the estate of Mildred DeRoin, deceased.

The facts were all stipulated in the district court. Mildred DeRoin died intestate, unmarried and without issue, leaving as her only surviving relatives, a paternal half-brother, Norman DeRoin, a paternal grandfather, John DeRoin, and a maternal half-uncle, John P.
