Mason, J.:

The defendant was convicted of grand larceny, and appeals. He was charged in one count with stealing a lady’s suit worth $99.50, a- lady’s waist worth $6.75, and a wrist watch worth $6.75, and was found guilty of stealing property worth $75. The suit and'waist were stolen on the third floor of a department store and the watch on the first. The defendant contends that the evidence conclusively shows that the goods on the different floors were taken by at least two separate acts constituting distinct offenses, and on that account complains of…
