DENNIS, Circuit Judge:

On May 18, 1999, a highway patrolman with the Texas Department of Safety, Bruce Dalme, stopped two vehicles traveling eastbound on Interstate 20 between Dallas/Fort Worth, Texas, and Shreveport, Louisiana, for following too closely behind an 18-wheeler. A red Chrysler Concorde, driven by Andre Gillyard’s girlfriend Natasha Lawrence and in which Appellant Andre Gillyard was a passenger, followed the 18-wheeler two car lengths behind.
