SUMMARY ORDER

Plaintiff-appellant Audio Emotion S/A (“Audio Emotion”) appeals from (1) an August 8, 2016 judgment of the district court granting a motion filed by defendant-ap-pellee McIntosh Group, Inc. (“McIntosh”), d/b/a Fine Sounds Group (“FS Group”), to dismiss the amended complaint, and (2) a January 11, 2017 order denying Audio Emotion’s motion to alter or amend the judgment and for leave to file an amended complaint.
