The motion at bar presents the question of what state law to apply in Federal Tort Claims Act (“FTCA”), 28 U.S.C. §§ 1346(b), 2671-2680, cases, when the act of negligence and the accident resulting from the negligence occur in two different states. Aso presented is whether the choice of law rule for the substantive issues operates also to determine the appropriate remedies or measure of damages.
