The Plaintiff, Jose Huezo (“Huezo”), seeks judicial review of the final decision of the Defendant, the Chelsea Housing Authority (“the CHA”), which disqualified Huezo for state and federal housing benefits based on his history of non-payment of rent. Huezo claims that the CHA’s decision was erroneous and must be reversed because in both instances where he refused to pay rent, he had a statutory right to withhold rent under G.L.c. 239, §8A.
