WALTERS, Chief Judge.
This is an appeal from an order denying a petition for a writ of habeas corpus. The petition was filed by Gilbert Chapa to test the procedure by which he had been returned to custody following his escape from prison. Contending the district court erred in refusing to grant habeas corpus relief, Chapa presents the following arguments. First, he submits that he was taken into custody under a bench warrant issued by the sentencing court when that court no longer had jurisdiction over him.
