This case was commenced in 1990 by Matrix Essentials, Inc. (“Matrix”), the alleged predecessor in interest to present plaintiffs L’Oreal USA, Inc., L’Oreal USA Products, Inc., L’Oreal USA S/D, Inc. and L’Oreal Creative, Inc. (collectively “Plaintiff’ or “L’Oreal”). The original complaint set forth causes of action in breach of contract, fraudulent inducement, misrepresentation and trademark infringement.
