I. INTRODUCTION
This case features a law firm as the unfortunate victim of a scam in which it lost $176,750. The law firm, Morris James LLP (“plaintiff’), now seeks to recover the money under the provisions of an insurance policy (“the Policy”) issued to it by Continental Casualty Company (“defendant”). Plaintiff originally filed its complaint against defendant on November 30, 2010 in the Superior Court of the State of Delaware in and for Kent County. (D.I. 21, ex.
