This was an action at law brought in the superior court of Cook county to recover damages under section 13, article TI, of the 1870 constitution. The trial court rendered judgment in favor of the plaintiff for $1275 and costs, from which judgment the defendant appealed.

On November 3, 1938, the city council of the city of Chicago passed an ordinance providing for the construction of a system of subways for local transportation purposes, which subways were to belong to the city.
