SUGARMAN, District Judge.

On June 8, 1949, Pantcho Nakasheff, as plaintiff, commenced an action in the New York Supreme Court, against Continental Insurance Company of New York, as defendant. The complaint, in substance, alleged that the defendant, a domestic insurance corporation, on November 9, 1946, for a premium paid by the plaintiff, insured against loss or damage a certain quantity of Bellabulgara to be shipped from Sofia, Bulgaria to Pearl River, New York; that, thereafter, the merchandise arrived in New York, was placed in a warehouse for a few days and was thence transported to the…
