The question here presented involves the right of appellants, who are second cousins, to share with first *332cousins in the distribution of the estate of an intestate, there being-no nearer kindred.

The Act of June 7, 1917, P. L. 429, designates the persons who are entitled to the real and personal estate of an intestate after the payment of all just debts and legal charges. The first eight sections of the statute determine the distributive shares of the spouse, issue, father and mother; and, in absence of these, the ninth section provides for a division…
