OPINION
DAY, Justice.
Appellee Ubong “Rockey” Akpan sued Burlington Northern Railroad Company (“Burlington”) for discrimination on the basis of race and national origin under the Texas Commission on Human Rights Act regarding termination of his employment. See Tex. Lab.Code ANN. § 21.051 (Vernon 1996). Burlington filed a motion to compel arbitration and to stay the suit pending completion of binding arbitration.
