OPINION

LUMPKIN, Vice-Presiding Judge.

Appellant, Anthony Ray Rowland, was tried by a jury for the crimes of Count I, Burglary in the First Degree, and Count II, Assault with a Dangerous Weapon, in the District Court of Tulsa County, Case No. CRF-87-1002. After deliberation, the jury returned verdicts of guilty of Count I, Burglary in the First Degree and set punishment at seven (7) years imprisonment, and not guilty of Count II, Assault with a Dangerous Weapon.
