JOHNSON, Presiding Judge:

Sahib Al-Mosawi, hereinafter referred to as Appellant, was tried and convicted by jury for the crimes of Murder in the First Degree, malice aforethought, (Counts I and II) (21 O.S.1991, § 701.7), and Assault and Battery with a Deadly Weapon with Intent to Kill (Count III) (21 O.S.1991, § 652) in Case No. CF-92-7217 in the District Court of Oklahoma County before the Honorable Richard Freeman, District Judge.
