MEMORANDUM OPINION

GEX, District Judge.

This cause comes before the Court on the motion of the defendant, Boston Old Colo ny Insurance Company [Boston], for dismissal for lack of subject matter jurisdiction pursuant to Rule 12(b)(1) and/or summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure or alternatively, to transfer venue pursuant to 28 U.S.C. § 1404(a). The Court, having duly considered the record in this action, in addition to the briefs of counsel, and being fully advised in the premises, concludes as follows:
