This is an application to this court for a writ of mandamus to compel the respondent, who is judge of the district court of Brazoria county, to proceed to trial and judgment in a suit in said district court brought by the relator against the Markham Irrigation Company, filed in No vember, 1917. The nature of the suit and the facts upon which relator asks for a writ of mandamus are stated in the application as follows:
