Relator seeks a mandamus under Article 1824, Vernon’s Ann.Civ.Stats., compelling the district judge to set his cause of action for trial. Relator instituted suit against respondents Briggs and Killian in the District Court of Bexar County and charged them with causing an explosion resulting in damages to relator’s home.
