In this diversity action, after a contested trial upon the merits, the jury on June 1 returned a verdict of $8,000 for the plaintiff. Judgment was entered forthwith by the Clerk.1 June 5 defendant filed a motion for a new trial.2 June 8 defendant’s counsel ex parte and without notice to plaintiff’s counsel asked and was granted permission to assign additional reasons upon receipt of a copy of the transcript of testimony, provided a copy of the transcript was ordered.
