April 30, 1880, tbe defendant leased to tbe plaintiff three rooms in tbe basement of tbe Williams block, in tbe city of Detroit, for tbe purpose of a saloon and restaurant, for the term of one year, and tbe plaintiff entered and occupied under such lease. A copy of the lease *101appears below.* In tbe fall of the same year the defendant wished to put an elevator in the block, and he applied to Ives for permission to go upon the leased, premises and occupy.a portion for such purpose, and the desired license was given in writing, and a copy of it also appears below. † (See p. 104.)
