Demurrers to the amended complaint having been sustained, the plaintiff elected to stand upon its pleading, and a judgment was entered dismissing the action. .

As stated by the complaint, the facts are these: On April 28, 1923, the city of Seattle entered into a contract with the respondent Sparger, whereby the latter obligated himself to construct a- certain public improvement. Shortly thereafter, he executed a bond to the city for the purpose of complying with the statutes hereinafter mentioned, the respondent, The Aetna Casualty & Surety Company, being the surety.
