This Court granted certiorari to review the Court of Appeals’ decision in Lopez v. National General Ins. Co., Op. No. 91-UP-058 (S.C. Ct. App. filed March 20, 1991). The Court of Appeals affirmed the ruling of the circuit court, declining to consider the case on its merit based upon its finding that the issue on appeal was neither raised nor ruled upon in the circuit court.
