RULING ON DEFENDANT’S MOTION TO DISMISS

DALY, District Judge.

These lawsuits were precipitated by the February 14, 1990 public announcement that quantities of benzene, a petro-chemical and possible carcinogen, had been identified in a widely consumed, sparkling mineral water. See Malone Deck at Exh. A.
