This proceeding was instituted in the Harlan circuit court by the appellant Charles Kavinedus, as a common-law action against the Citizens National Bank of Harlan, Ky., seeking to recover possession of a certain $9,000 lien note (of which he alleged he was the owner), which had been pledged as collateral to the defendant bank for certain designated indebtedness owing it, the payment of which he alleged had been made or tendered the bank, but that notwithstanding its satisfaction, he claimed the bank was nonetheless wrongfully detaining his pledged…
