The appellant, W. H. Clark, .sued the appellee, W. P. Isaacs, and by his petition, claimed, that, he and the appellee, on the first day of December, 1909, entered into a contract, which was reduced to writing, and by the terms of which it was agreed, that he would furnish the appellee with $500.00 worth, or more, of goods, wares and merchandise; would pay for them and their transportation to the place of business of the appellee and would fix the price's at which the goods should be sold by the appellee..
