Sophie C. Miller, who is not a duly licensed physician, appeals from a judgment imposing a year’s imprisonment and a $500 fine upon conviction of the felony of abortion under § 559.100. (Statutory references are to RSMo 1949 and Y.A.M.S. unless otherwise stated.) Defendant attacks the indictment, the sufficiency of the evidence, rulings of the court on the opening statement and argument for the State, the admission of evidence, and an instruction.
