WYZANSKI, District Judge.

The case is before me on a motion to dismiss the complaint on the ground, among others, that, since the complaint does not show plaintiffs have exhausted their administrative remedies, the complaint fails to state a cause of action.

In substance these are the allegations of the complaint. Four ungraded civilian employees of the United States Department of the Navy who are presently employed in the civil service at the Boston Naval Shipyard charge that the Captain in command of that yard and certain other high officials at that yard have denied them, and others in like…
