McGRANERY, District Judge.
Plaintiff, a Pennsylvania resident, was injured on August 20, 1943, when the automobile in which she was a passenger collided in Chester, Pa., with a truck. On May 24, 1945, she brought suit in this court against the driver of the truck, Mr. Dykes, a resident of Delaware, and the Victor Lynn Lines, Inc., owner of the truck, and a Maryland corporation. On June 22, 1945, the above-named defendants obtained an order of this court under Federal Rule 14, 28 U.S.C.A. following section 723c, to summon, as a third-party defendant, William J.
