This matter is before the court on defendant Stuart-James’s motion to compel plaintiff to arbitrate, Stuart-James’s motion to dismiss for failure to state a claim, and defendant Michael J. Whalen’s motion to dismiss pursuant to Fed.R.Civ.P. 4(j). This complaint was filed September 11, 1989, and amended December 5, 1989, against the Stuart-James Company and Michael J. Whalen.
