This appeal is from a judgment for damages for the death of the plaintiff’s husband at a railroad crossing in Newton.

The railway company has thirteen parallel tracks extending northeast and southwest through the city connecting its 'local yards. These tracks cross First street, which extends east and west, in a populous part of the city. The direction of the tracks will be referred to as north and south.
