Cross-appeals from a judgment of the superior court for King county, Ronald, J., entered March 27, 1915, in favor of the plaintiff, in an action for specific performance, tried to the court.

In 1902 the town of Bremerton, now a city of the third class, granted to H. Orchard and his assigns a thirty-year franchise for the sale of water to the town and its inhabitants. The contested feature in this franchise was § 2, of which we have italicized the most material portions:
“The rights hereby granted to the said grantees by the first section of this ordinance shall be for the period of thirty years after the passage and approval of this ordinance and after the acceptance of the same by the grantees.
