This suit involves the' ownership of Lot 5, Sundby’s Subdivision to the City of Minot, Ward.County, North Dakota. Both the plaintiff and the defendant, Reinhold Polsfut, claim ownership and each asks that title be quieted in him. The plaintiff claims ownership by virtue of deeds he received from the heirs of Elizabeth F. Wilson. The defendant, Polsfut, claims ownership by virtue of an executed purchase of the propérty from the same heirs. The othér defendants default.
