Appeal from a judgment of the Supreme Court (Lambert, J), entered November 29, 2012 in Delaware County, which dismissed petitioner’s application, in a proceeding pursuant to CFLR article 78, to annul respondent Andes Town Board’s adoption of Resolution No. 31 of 2011.
