MEMORANDUM AND ORDER
LUNGSTRUM, District Judge.
This matter is presently before the court on plaintiffs motion to dismiss defendant’s counterclaim for lack of subject matter jurisdiction (Doc. # 4). For the reasons set forth below, plaintiffs motion is granted.

On September 3, 1997, plaintiff Joy K. Adamson filed a complaint against defendant Dataco Derex, Inc. alleging various claims arising out of her employment with Dataco.
