On November 30, 1931, the appellees, Eugene Phillips and others, filed a motion in this court to strike out the transcript and statement of facts filed and dismiss the appeal because the appellant, Texas & Pacific Railway Company, failed to file the transcript in this court, and failed to file the statement of facts in the lower court within the time prescribed by law. The record tendered shows that the final judgment in *266the cause was rendered in the trial court July 7, 1931. The appellant’s motion for a new trial was overruled July 30, 1931.
