COXE, District Judge.
These two suits are for infringement of the Hibbard reissue patent, No. 17,180, granted January 1, 1929, for a synchronous motor starting and control system. The original Hibbard patent, No. 1,640,322, was issued August 23, 1927, on an- application filed January 17, 1920, and the reissue was for the purpose of adding a number of additional claims. All of the claims now in *941issue appeared, however, in the original patent, with the exception of claims 20 and 21, and the only infringement alleged with respect to those two claims took place after the reissue patent was granted.
