In this will contest case, Delmer Ur-banczyk contends his mother, Isabel Ur-banczyk, lacked testamentary capacity in April 2003 when she executed a will or the will was the result of the undue influence, duress, or fraud of his brother Marvin Urbanczyk and Marvin’s wife Janet Ur-banczyk. 1 Delmer also sued Marvin and Janet for tortious interference with inheritance rights and alleged Marvin and Janet breached fiduciary duties owed Isabel.
