This is an action brought by the board of county commissioners of Sheridan County for the purpose of having the location of the boundary line between that county and the adjoining county of Crook definitely settled in the manner provided by statute. (Rev. Stat. 1899, Secs. 994-1001.) The cause' was submitted to the district court upon an agreed statement of facts, and thereupon a judgment was rendered in favor of Sheridan County, the plaintiff, granting its application for the appointment of a competent surveyor to survey the disputed boundary line.
