On November 28, 1898, the plaintiff delivered to the defendant $10,625, to be used in the purchase of 100 shares of the capital stock of the Farmers’ & Traders’ National Bank of La Grande. 1. The defendant moves to dismiss the appeal on the ground that the transcript was not filed within the time allowed by law. The statute requires the transcript on appeal to be filed with the clerk of this court within 30 days after the appeal is perfected: B. & C.
