Appellant was convicted in the criminal district court of Tarrant county, Tex., of the offense of murder, and his punishment fixed at confinement in the penitentiary for a period of 10 years.
• An extended statement of the facts in this case would serve no useful purpose. All parties to the transaction were negroes, and the homicide occurred in front of a negro restaurant, above which was a social club, frequented by members of the same race. It appears that a difficulty had occurred in said social elubroom between appellant and a negro named Waldon, and that after said difficulty occurred…
