MEMORANDUM DECISION
CHIN, District Judge.
In this admiralty action, intervenor-de-fendant Blanc Navigation (“Blanc”) counterclaims for a declaratory judgment that plaintiff Kristensons-Petroleum, Inc. (“KPI”) does not possess a maritime lien against a vessel owned by Blanc and had no right to arrest the vessel for the alleged failure of the vessel’s operator, defendant Sealock Tanker Co., Ltd. (“Sealock”), to pay KPI for fuel purchases. KPI moves to dismiss Blanc’s counterclaim and to strike Blanc’s answer to the underlying complaint.
