Plaintiff, Dorothy Lee Bemis, and defendant, Kenneth W. Bemis, were married in 1938, they separated in 1943 and were divorced by final decree in 1945. There are two children, Kenneth aged about 5% years, and Dorothy aged about 7 years. In her complaint for divorce Mrs. Bemis charged cruelty. She alleged that the children were then in the custody and under the control of defendant’s mother and the prayer of the complaint was that the court make “such order for the custody and control of the minor children of the parties as may be proper.” Defendant filed a cross-complaint in which he accused…
