OPINION

JOE SPURLOCK, II, Justice.

Appellant, Jimmie Davis Watson, was convicted by a jury for the offense of burglary of a habitation. See TEX. PENAL CODE ANN. sec. 30.02 (Vernon 1974). The jury found the enhancement paragraph of the indictment was true, and the court sentenced Watson to 25 years imprisonment.

This Court reversed the judgment and remanded the case for a new trial based on error in the court’s charge.1 Subsequently, the Texas Court of Criminal Appeals reversed this Court’s decision and held that the error in the court’s charge was harmless.2 The case is now before us for…
