Defendants in error, owners of certain real and personal property used in the operation of a cotton gin at Keota, Haskell county, Okla., on June 1, 1925, entered into a contract with defendant, Harvey Price, whereby Price became interested as a partner in the operation of the ginnery, and with the right to have conveyed to him a one-fourth interest in the property upon completion of payments to be made from profits of the business. Acknowledgment of payment of $1,000 by Price to defendants in error was recited in the contract. So was the amount of $2,437.50 recited to be owing and to be paid…
