This case arises out of a dispute over the terms of a settlement agreement between business competitors. One party brought a declaratory judgment action seeking various declarations regarding the terms of the settlement agreement. The trial court granted the plaintiffs motion for summary judgment, impliedly making the three declarations sought in the motion. The defendants never sought declaratory relief; rather, they asserted in a cross-motion for summary judgment that all of the requested declarations should be denied as a matter of law. We…
