In this action the appellee, as- plaintiff,, sued the appellant, as defendant, to enforce art allegedi *18mechanic’s lien on certain real estate, particularly described, in Hancock county.

In his complaint, the appellee alleged, in substance, that, in the winter of 1875, the appellant contracted with and employed one William Morford to build for him, the appellant, a frame dwelling-house, one and one-half stories high, on certain real estate, described in said complaint, in said county, in consideration of which the appellant promised to pay said Morford the sum of -’ dollars; that the appellee…
