The Nashville Trust Company, guardian of Sallie Cooper, filed the bill in this cause in 1940, asserting a right to an easement of way over a small part of defendant’s land and seeking to enjoin him from erecting a fence and obstructing the use of this easement. On May 8, 1944, L. C. Anderson and wife, who in the meantime had acquired the land of Sallie Cooper, filed their petition in this cause and were substituted in the place of the original complainant.
