Appeal by the defendant from a judgment of the County *816Court, Nassau County (Peck, J.), rendered April 9, 2008, convicting her of criminal possession of a controlled substance in the fourth degree, upon her plea of guilty, and imposing sentence.
Ordered that the judgment is reversed, on the law, the plea is vacated, and the matter is remitted to the County Court, Nassau County, for further proceedings on the indictment.
